Terms of Service

These Terms of Service ("Terms") govern your access to and use of the email verification services, website, API, and related products provided by Email Verifier by EcomTech ("we," "us," or "our"). By creating an account, accessing our website, or using any of our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

1. Acceptance of Terms

By accessing or using our services, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered account holders or through a prominent notice on our website at least 30 days before taking effect. Your continued use of our services after changes take effect constitutes acceptance of the modified Terms.

2. Service Description

Email Verifier by EcomTech provides email verification and validation services, including but not limited to:

  • Single email verification: Real-time verification of individual email addresses through our website or API
  • Bulk email verification: Batch processing of email lists uploaded via CSV, Excel, or text files
  • Email verification API: RESTful API endpoints for integrating email verification into your applications
  • Disposable email detection: Identification of temporary and throwaway email addresses
  • Email deliverability tools: SPF, DKIM, DMARC checking and other deliverability diagnostics

We strive to provide accurate verification results but cannot guarantee 100% accuracy due to the inherent limitations of email verification technology, including catch-all servers, greylisting, and temporary server issues. Our stated accuracy rate of 99.5% represents our overall accuracy across a large sample of verifications.

3. Account Registration

To access certain features of our services, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and promptly update your account information to keep it accurate and current
  • Maintain the security of your password and API keys
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You may not create multiple free accounts to circumvent usage limits. We reserve the right to suspend or terminate accounts that we reasonably believe are duplicate or fraudulent.

You are solely responsible for maintaining the confidentiality of your API keys. Treat your API keys as you would a password. If you believe your API key has been compromised, regenerate it immediately through your account dashboard.

4. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You may not use our services to:

  • Send spam or unsolicited emails: Our services are for verification purposes only. You may not use verification results to send unsolicited commercial email to addresses that have not opted in to receive communications from you.
  • Harvest or scrape email addresses: You may not use our services in connection with email addresses that were obtained through scraping, harvesting, or purchasing from unauthorized sources.
  • Verify emails for illegal purposes: You may not use our services to verify email addresses for any illegal activity, including fraud, identity theft, phishing, or harassment.
  • Overload our systems: You may not attempt to overwhelm our servers through excessive API requests, denial-of-service attacks, or other means designed to disrupt our services.
  • Reverse engineer our systems: You may not decompile, disassemble, reverse engineer, or attempt to derive the source code of our software, algorithms, or verification processes.
  • Resell without authorization: You may not resell, redistribute, or white-label our services without a written reseller agreement from us.
  • Circumvent rate limits: You may not use multiple accounts, IP addresses, or other techniques to bypass API rate limits or usage restrictions.

Violation of these acceptable use policies may result in immediate suspension or termination of your account without notice or refund.

5. Payment Terms

5.1 Pricing and Plans

Our current pricing is available on our pricing page. Prices are listed in US dollars and do not include applicable taxes. We reserve the right to change pricing at any time, but changes will not affect existing prepaid credits or the current billing period of active subscriptions.

5.2 Pay-As-You-Go Credits

Credits purchased on a pay-as-you-go basis do not expire. Each credit allows you to verify one email address. Unused credits remain in your account until used. Credits are non-transferable between accounts.

5.3 Monthly Subscriptions

Monthly subscription plans renew automatically on the same day each month. Unused verifications from a monthly plan do not roll over to the next month. You may upgrade, downgrade, or cancel your subscription at any time through your account dashboard. Downgrades and cancellations take effect at the end of the current billing period.

5.4 Payment Processing

All payments are processed securely through Stripe. We do not store your credit card information on our servers. By providing payment information, you authorize us to charge the applicable fees to your selected payment method.

6. Refund Policy

We offer a 14-day money-back guarantee on all paid plans and credit purchases, subject to the following conditions:

  • Refund requests must be submitted within 14 days of the original purchase date
  • Refunds are available if you have used fewer than 10% of the purchased verifications or credits
  • Refunds are processed to the original payment method within 5 to 10 business days
  • Free trial verifications are not eligible for refunds
  • Accounts terminated for acceptable use violations are not eligible for refunds

To request a refund, contact us at support@ev.ecomtechbd.com with your account email address and the reason for your request. We will process eligible refunds promptly.

If you are not satisfied with our service for any reason, please contact our support team before requesting a refund. We are often able to resolve issues and improve your experience.

7. Data Processing

When you use our services to verify email addresses, you are the data controller and we are the data processor for the email addresses you submit. Our obligations as a data processor include:

  • Processing email addresses only for the purpose of performing the verification you requested
  • Not using submitted email addresses for any other purpose, including marketing or data enrichment
  • Automatically deleting uploaded email lists and verification results within 24 hours of job completion
  • Providing a zero retention option for customers who require immediate deletion after result download
  • Implementing appropriate technical and organizational security measures to protect the data
  • Not transferring data to third parties except as required to provide the service

You are responsible for ensuring that you have the legal right to process the email addresses you submit to our service. You represent and warrant that you have obtained all necessary consents or have another lawful basis for processing the email data you submit.

8. Intellectual Property

All intellectual property rights in our services, including but not limited to our website design, software, algorithms, trademarks, logos, and documentation, are owned by Email Verifier by EcomTech or our licensors. These Terms do not grant you any rights to our intellectual property except the limited right to use our services as described in these Terms.

You retain all rights to the data you submit to our services, including email lists and any other content you upload. We do not claim ownership of your data.

You may not use our name, logo, or trademarks without our prior written permission, except to accurately describe your use of our services (e.g., "Verified by Email Verifier by EcomTech").

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that our services will be uninterrupted, error-free, or completely secure.
  • We do not warrant the accuracy of verification results. While we strive for 99.5% accuracy, some email addresses may be incorrectly classified due to factors beyond our control.
  • In no event shall our total liability to you for all claims arising from or related to your use of our services exceed the total amount you have paid us in the 12 months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, loss of business opportunities, or loss of goodwill, regardless of whether we were advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Email Verifier by EcomTech, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from or related to:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your submission of email addresses that you did not have the right to process
  • Any claim that your use of our services infringed or violated the rights of a third party

11. Termination

You may terminate your account at any time through your account dashboard or by contacting us at support@ev.ecomtechbd.com. Upon termination:

  • Your access to paid features will continue until the end of the current billing period
  • Unused pay-as-you-go credits will be forfeited 30 days after termination unless a refund is requested within the 14-day refund window
  • All data associated with your account will be deleted within 30 days of termination
  • Any uploaded email lists will be deleted immediately upon account termination

We may suspend or terminate your account immediately and without notice if:

  • You violate any provision of these Terms, particularly the acceptable use policies
  • We are required to do so by law or regulation
  • We reasonably believe your account has been compromised
  • Your payment method is declined and you do not provide an alternative within 7 days

12. Service Availability and Modifications

We strive to maintain 99.9% uptime for our services but do not guarantee uninterrupted availability. We may temporarily suspend access for maintenance, upgrades, or emergency repairs. We will provide advance notice of scheduled maintenance when possible.

We reserve the right to modify, suspend, or discontinue any feature or aspect of our services at any time. If we discontinue a material feature, we will provide at least 30 days' notice to affected users.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Bangladesh, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the applicable arbitration rules.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Email Verifier by EcomTech regarding your use of our services. These Terms supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
